These Terms of Service ("Terms") govern your access to and use of https://topgearautospa.com (the "Site") and any services provided by Top Gear Auto Spa LLC ("Top Gear Auto Spa," "we," "us," or "our"). By accessing the Site or using our services, you agree to be bound by these Terms.
Services
Top Gear Auto Spa provides automotive detailing, paint protection film, ceramic coating, window tinting, paint correction, vinyl wrap, paintless dent removal, and architectural window film services in Bergen and Passaic counties, New Jersey. Specific service details, pricing, and timelines are confirmed in your individual estimate or work order.
Estimates and quotes
All estimates provided through the Site or otherwise are non-binding until a written work order is signed by both parties. Final pricing depends on the condition of your vehicle or property at the time of inspection.
Appointments and cancellations
Appointments are scheduled in advance and confirmed via phone or email. We ask that cancellations be made at least 24 hours before your scheduled appointment. No-shows or late cancellations may be subject to a fee.
Payment
Payment terms are stated in your individual work order. Unless otherwise agreed, payment is due upon completion of services. We accept major credit cards, debit cards, and cash.
Warranties
Products we install (XPEL paint protection film, ceramic coatings, window tints, and related materials) are covered by manufacturer warranties issued by the manufacturer, not by us. Manufacturer warranty terms vary by product and are provided at the time of installation.
We provide a separate workmanship warranty covering installation defects. The terms of our workmanship warranty are provided in your work order. EXCEPT AS EXPRESSLY STATED, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Customer responsibilities
You agree to:
- Provide accurate information about your vehicle or property
- Disclose any prior damage, repairs, or paintwork
- Follow post-installation care instructions provided to you
- Allow us to inspect work before signing off on completion
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TOP GEAR AUTO SPA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE OR OUR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM.
Intellectual property
All content on the Site — including text, images, logos, and design — is owned by Top Gear Auto Spa LLC or its licensors and is protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works without our written permission.
Third-party links
The Site may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party site.
Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be brought in the state or federal courts located in Bergen County, New Jersey.
Changes to these Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
